1. Acceptance of Terms

Homie Systems (“we,” “us,” “our”) provides smart websites, CRM tools, automated messaging, marketing services, and related software-enabled solutions for home service businesses. By creating an account, accessing a website we build, or using any Homie Systems service, you agree to these Terms of Service (“Terms”).

If you do not agree to these Terms, do not use our services.

2. Description of Services

Homie Systems offers:
• Website creation and hosting
• CRM and contact management
• Automated SMS and email follow-up
• Review collection tools
• Calendar and scheduling tools
• Call tracking
• Marketing services (ads management, SEO content, direct mail, and others depending on your plan)

Service levels are defined in your plan selection. The Foundation, Elevation, and Domination tiers each include different features as described on our site.

We may update or improve features at any time.

3. Eligibility

You must be at least 18 years old and operate a legitimate business to use Homie Systems.

4. Account Responsibilities

You agree to:
• Provide accurate business information
• Maintain account confidentiality
• Use the services only for lawful business activities
• Not attempt to reverse engineer, copy, or reproduce our systems

You are responsible for all activity occurring under your account.

5. Payments, Billing, and Refunds

All plans are billed monthly unless stated otherwise.

• Foundation: $297 per month
• Elevation: $797 per month
• Domination: $2997 per month (3-month minimum)
We offer a 30-day money-back guarantee for Foundation and Elevation plans. Cancellation after 30 days will end future billing, but no refunds are issued for prior charges.

For annual or discounted commitments, cancellation requires payment of any prorated difference if a discount was applied based on term length.

6. Cancellation and Termination

You may cancel at any time through your dashboard or by contacting support. Cancellation will prevent future billing but will not automatically delete data.

We may suspend or terminate accounts for:
• Non-payment
• Misuse of services
• Illegal, abusive, or harmful behavior
• Violations of these Terms

7. Websites, Funnels, and Marketing Material

You retain ownership of your business content (logo, copy, media). We retain ownership of:
• Website templates
• Automations
• Funnels
• Software configurations
• Proprietary systems

If you cancel, you may request a static HTML export of your website, but CRM functions, automations, and platform features cannot be transferred.

8. Communications and Messaging Compliance

Our platform allows sending automated SMS and emails. You are responsible for compliance with applicable laws, including but not limited to:
• TCPA
• CAN-SPAM
• Local or industry regulations

You must only send messages to contacts who have provided appropriate consent.

9. Service Availability

We strive for reliable uptime but do not guarantee uninterrupted access. Scheduled maintenance may occur. We are not liable for outages outside our control.

10. Marketing Performance

We make no guarantee of leads, revenue, or specific business outcomes. Performance varies by market, budget, competition, and adherence to recommended best practices. This aligns with our brand messaging that systems are tools, not magic.

11. Limitation of Liability

To the maximum extent permitted by law:
• Homie Systems is not liable for indirect, incidental, special, consequential, or punitive damages.
• Liability for direct damages will not exceed the amount paid in the past 3 months.

12. Indemnification

You agree to indemnify and hold harmless Homie Systems from claims arising out of:
• Your use of the services
• Data you input into the system
• Messages you send
• Your business operations

13. Changes to Terms

We may update these Terms at any time. Continued use constitutes acceptance.
